01Purpose and acceptance
These terms govern the use of the Pocket app, published by NETMESAFE. By installing or using the app, you accept them.
They come in addition to Apple’s App Store terms and to Apple’s standard end-user licence agreement, linked in section 11. Where they conflict on the software licence itself, Apple’s agreement prevails.
02The licence granted to you
You are granted a personal, non-exclusive, non-transferable right to use Pocket on Apple-branded devices that you own or control, within the limits of the App Store Usage Rules.
That right is licensed, not sold: you acquire the use of the software, not its ownership.
- You may not resell, rent, redistribute or sub-licence the app.
- You may not decompile, disassemble or extract its source code, except where the law expressly allows it.
- Using the app professionally, for your own business, is however intended and permitted.
03What the free tier includes
The app is free to download. Without a subscription you get one business card and three automatic summaries per month.
Unlimited even without a subscription: recording, transcription, written notes, card scanning, the encounter book and the exports.
04The Premium subscription
Premium costs $3.99 per month or $24.99 per year in the United States, €4.99 / €29.99 in the eurozone. The price shown in the App Store applies.
It follows a one-week free trial, and lifts both the card limit and the automatic summary limit.
Apple sets the price of every other territory from these amounts: the price shown in the app at the time of purchase is the one that applies.
The purchase goes through the App Store and is charged to your Apple Account when you confirm the order.
05Renewal and cancellation
The subscription renews automatically for the same duration unless cancelled at least 24 hours before the end of the current period. Renewal is charged within the 24 hours before that date.
Cancellation happens in iOS Settings, your Apple Account, then Subscriptions. It takes effect at the end of the period already paid for, which remains yours.
If you subscribe during the free trial, the unused part of that trial is forfeited, in line with Apple’s rules.
Apple handles the subscription end to end. NETMESAFE has no access to it and can neither extend, stop nor refund it.
06Right of withdrawal
Subscriptions are sold by Apple, acting as reseller. The right of withdrawal available to European Union consumers is therefore exercised with Apple, under the Apple Media Services terms, from the App Store “Report a Problem” page or from your purchase history.
NETMESAFE does not collect the payment and cannot issue a refund in Apple’s place.
07No account, no server: what follows from it
Pocket creates no account and sends your data to no NETMESAFE server. Your cards, encounters, recordings, transcripts and summaries stay inside the app, on your device.
That is the product’s central commitment, and it has three contractual consequences worth knowing before you subscribe:
- Nothing syncs between your devices: changing iPhone does not carry your data over.
- Deleting the app erases its data, with no way for us to recover it.
- Backup is on you: the app lets you export as vCard or spreadsheet, but you have to do it.
08Availability and limits of the service
Pocket runs on iPhone and Apple Watch. No iPad, no Mac, no Android.
Automatic summaries rely on Apple Intelligence: they are only available on devices that support it, with the feature switched on. Recording and transcription work on every supported device.
The app evolves: features may be added, changed or removed, not least to follow changes in iOS. Uninterrupted availability is not guaranteed.
09Intellectual property
The app, its name, its interfaces and its card templates remain the property of NETMESAFE.
What you produce with it — your cards, your encounters, your recordings, your notes — belongs to you. NETMESAFE has no access to it and claims no right over it.
10Warranties and liability
The app is provided as is, within the limits allowed by law. It does not replace any archiving or retention obligation that may otherwise apply to you.
You remain responsible for how you use it. In particular, when you record a conversation, it is up to you to inform the other parties and to comply with the applicable law.
Nothing in these terms sets aside the statutory guarantees you enjoy as a consumer, in particular the legal guarantee of conformity and the guarantee against hidden defects.
11Apple’s standard licence agreement
In the absence of a custom licence agreement, Pocket is distributed under Apple’s standard end-user licence agreement, which governs the software licence.
Apple is not a party to these terms and has no obligation to provide support or maintenance for the app: support is provided by NETMESAFE, at the address below.
Apple’s standard licence agreement12Governing law and disputes
These terms are governed by French law. As a consumer resident in the European Union, you keep the benefit of the mandatory provisions of your country of residence and the right to bring proceedings before its courts.
In case of a dispute, you may use a consumer mediator free of charge before taking legal action.
13Changes to these terms
Any change will be published on this page, with a new update date. The version that applies to a subscription is the one in force on the day it was taken out or renewed.
